In Oregon, you can absolutely sell a rental property with a tenant in place — and it’s actually quite common.
The key is whether the buyer wants to keep it as a rental or move in themselves.
If the buyer is another investor, having a good tenant already in place can actually make your property more valuable — it’s cash-flowing from day one.
UNDERSTANDING OREGON LAW
Under Oregon law, a tenant’s lease remains valid even if the property is sold.
That means the new owner must honor the existing lease until it expires.
If the tenant is month-to-month, the new owner can issue a 90-day notice to terminate — but only if they plan to move in or meet one of the allowable reasons under Oregon’s landlord-tenant law.
You cannot just end the tenancy because you want to sell.
BENEFITS OF SELLING WITH A TENANT
Selling with a tenant in place can have some big advantages:
You keep collecting rent until closing.
You avoid vacancy costs and turnover work.
